Статтю присвячено одному з найактуальніших питань сучасної науки цивільного процесу – принципу "case management", який упродовж останніх двадцяти років упевнено завойовує чільне місце під сонцем реформ цивільного процесуального законодавства в європейських державах. Основою для цього дослідження стала національна доповідь, підготовлена проф. Сільвестрі на конференцію Міжнародної асоціації процесуального права "Про судовий менеджмент у порівняльному аспекті", що відбулася 8–10 листопада 2017 р. у Тянчжині, КНР, друга сесія "Організація розгляду справ", основний доповідач – д-р Джон Сорабджі. Охарактеризовано положення реформованого цивільного процесуального законодавства України, в якому прослідковуються ідеї запровадження принципу "case management". Підготовлено пропозиції щодо визначення суті цього принципу та більш комплексної реалізації в законодавстві Італії та України.

"CASE MANAGEMENT" PRINCIPLE IN CIVIL JUSTICE: COMPARATIVE STUDY OF ITALIAN AND UKRAINIAN LAW

The aim of the article is to highlite one of the most current trand of civil procedure – the principle of "case management", which over the past twenty years confidently become one of the main reforming of civil procedural law in European states. The basis for this study was a national report, prepared by prof. Silvestra at the conference of the International Association of Procedural Law "On Judicial Management from comparative perspective", held on November 8-10, 2017 in Tianjin, China, the second session Case Management", the General Reporter Dr. John Sorabji. The article describes the provisions of the reformed civil procedural legislation of Ukraine, which follows the idea of introducing the "case management" principle. Proposals have been prepared to determine the essence of this principle and more comprehensive implementation in the legislation of Italy and Ukraine.
